Deposit money you owe to someone

You may deposit money if you, for example, owe someone money that refuses to accept the money, or if you cannot determine who should get the money. Apply for a deposit with the County Administrative Board.

If you owe a person money you may, in some cases, deposit the money (sätta ned) with the County Administrative Board. Your debt is then considered to be paid on time.

What are the requirements for making a deposit?

To deposit money you owe to someone, the debt’s due date must have passed.

Furthermore, the receiver must be the reason you cannot pay and one of the following requirements must be met:

  • The person to whom you owe money refuses to accept the payment.
  • You cannot pay because you cannot find the person to whom you owe money, or that person is sick, or other reasons that can be attributed to the person to whom you owe money.
  • You do not know who you owe money to.
  • Two or more persons demand money from you, and you cannot determine who should get the money.

Therefore, the reason you cannot pay your debt must be due to the recipient. You cannot make a deposit if you, for example, have a disagreement with a craftsman on how much to pay for a particular service or for purchasing the wrong product.

How do I make a deposit?

A deposit application consists of two parts:

  1. You send an application to the County Administrative Board.
  2. You pay the amount you want to deposit.

We cannot process the deposit application if one of these parts is missing.

Notify the person, or persons, to whom you owe money

Every time you deposit money, you must notify the person, or persons, to whom you owe money. If you fail to notify them, you may be required to compensate for any losses they might have suffered due to your failure of notification.

Apply for a deposit

To make a deposit of money you owe to someone, complete an application and send it to the County Administrative Board.

Pay the amount you want to deposit

Pay the amount you want to deposit to the County Administrative Board.

At the first payment

Please provide your corporate number, or social security number, and your name in the payment notification box (for example, “012345-6789, Company Ltd., Your Name”).

If you want to continue depositing your debt

State the lease’s expiration date and the case number that was given to you at the first deposit (for example, “October 1st, 208-2010-300, security deposit 10 000).

Which County Administrative Board will handle your case

Only seven County Administrative Boards handle these matters which means that you need to contact the County Administrative Board that is responsible for your county.

  • If you live in Stockholm, Uppsala, Södermanland, Gotland or Västmanland county, please contact the County Administrative Board of Stockholm.
  • If you live in Östergötlandå, Jönköping och Kalmar county, please contact the County Administrative Board of Östergötland.
  • If you live in Kronoberg, Blekinge och Skåne county, please contact the County Administrative Board of Skåne.
  • If you live in Halland och Västra Götaland county, please contact the County Administrative Board of Västra Götaland.
  • If you live in Värmland, Örebro, Dalarna och Gävleborg county, please contact the County Administrative Board of Dalarna.
  • If you live in Västernorrland och Jämtland county, please contact the County Administrative Board of Västernorrland.
  • If you live in Västerbotten och Norrbotten county, please contact the County Administrative Board of Norrbotten.

Does the matter regard a facility?

It is the County Administrative Board in the same count as the facility that handles your application. It’s also this County Administrative Board you pay the money to.

Does the matter apply to a company, association or other legal entity?

The County Administrative Board that handles the application is the one in the same county as where the indebted company is active.

Reimbursement

In your application to deposit money, you can state that you, in the future, want the right to be reimbursed. If you are reimbursed, it is considered that the deposit never was made, and you lose the protection that the deposit meant.

If the creditor (the one you ow money) has claimed the amount that you have deposited, you are usually not entitled to be reimbursed. You can only be given the money back if

  • the creditor approves that you are reimbursed
  • you are entitled to the money after the matter has been tried in court.

Application for payment

If you have deposited money or are the creditor, you can apply for payment of deposited money. The application must be in writing and signed by the person who wants to take out the money.
